Welcome to Yacht Cabin! These Terms & Conditions (“Terms”) govern your access to and use of our website and mobile application (“App”). By accessing or using Yacht Cabin, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our services.

Acceptance of Terms

By accessing or using Yacht Cabin, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our services.

User Accounts

Account Creation and Responsibilities

• Users can create accounts on Yacht Cabin.

• When creating an account, you must provide accurate and complete information.

• You are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account.

• You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

• Yacht Cabin will not be liable for any loss or damage arising from your failure to protect your account information.

Account Termination

We reserve the right to suspend or terminate your account at any time without notice for conduct that we believe violates these Terms, is harmful to other users of Yacht Cabin, us, or third parties, or for any other reason at our sole discretion.

User Responsibilities

Acceptable Behavior

• Users must engage in respectful and lawful behavior.

• Prohibited actions include harassment, abuse, threats, or any form of discriminatory speech or behavior.

• Users must not post content that is abusive, defamatory, obscene, offensive, or illegal.

Content Ownership

• Users retain ownership of any intellectual property rights that they hold in the content they upload to Yacht Cabin.

• By uploading content, you grant Yacht Cabin a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the services provided by Yacht Cabin and across different media.

Content Moderation

• Yacht Cabin reserves the right to remove or modify user content for any reason, including content that we believe violates these Terms or our policies.

• We may filter, review, and remove content that we deem to be objectionable or in violation of our terms.

Reporting and Blocking

• Users can report content they believe is abusive, defamatory, obscene, offensive, or illegal by contacting us at hello@ycabin.com.

• Users can block abusive users through their account settings or by contacting our support team.

Pricing and Crew Contributions

• Yacht Cabin is a neutral platform that does not set, manage, or enforce any pricing for crew contributions. Boat owners are solely responsible for setting any crew contribution and for ensuring they have the legal right to accept it.

• Any amounts listed by boat owners in the app are solely informational and do not constitute an offer, contract, or guarantee of services.

• Where a booking deposit is paid through the App, Yacht Cabin facilitates that payment as described in the “Payments and Deposits” section below. Any amount paid directly between users outside the App remains a private arrangement for which Yacht Cabin bears no responsibility.

• Yacht Cabin bears no responsibility for any financial or non-financial agreements made between users, nor does it verify whether a boat owner has the legal right to accept payments or other forms of compensation.

• The boat owner assumes full and sole responsibility for ensuring compliance with all applicable laws, regulations, and licensing requirements in their jurisdiction. Yacht Cabin disclaims all liability for any legal, regulatory, or financial consequences arising from such arrangements.

• Users acknowledge that by engaging in financial or non-financial exchanges, they do so at their own risk and must independently verify their obligations and legal standing.

Payments and Deposits

Payment processor. Payments through Yacht Cabin are processed by Stripe using Stripe Connect. Boat owners (“captains”) who receive funds must onboard as a Stripe connected account and agree to the Stripe Connected Account Agreement and Stripe Services Agreement.

No custody of funds. Yacht Cabin does not hold, control, or take custody of user funds. All funds are held and transferred by Stripe. Yacht Cabin is not a bank, payment institution, money transmitter, or escrow provider.

Booking deposit. The booking deposit is set by the boat owner and may be a partial deposit or the full crew contribution. When crew book a trip, they authorise payment of the booking deposit. The captain receives the deposit net of Stripe’s payment processing fees. Yacht Cabin does not take any commission from the deposit.

Release of funds. The deposit is held via Stripe and released to the captain up to 72 hours before the trip’s scheduled start.

Cancellations and refunds. Cancellations and refunds are governed by our Refund Policy. Once a deposit has been released to the captain, those funds are held by the captain, and any refund is subject to the captain and our Refund Policy; Yacht Cabin no longer holds the funds and cannot reverse them directly.

Chargebacks. If a payment is reversed, charged back, or refunded after release, the captain is responsible for reimbursing Yacht Cabin for any resulting shortfall, and Yacht Cabin may recover such amounts from the captain or their connected account.

Role. Yacht Cabin acts solely as a technical facilitator of payments between users and is not a party to the underlying agreement between users.

Identity Verification (Optional)

Optional service. Yacht Cabin offers an optional identity verification service that lets users confirm their identity and display a verified status. Verification is not required to use Yacht Cabin.

Fee. A one-time fee, in the amount shown at checkout, applies only if verification is successful. If verification cannot be completed or is unsuccessful, you are not charged. Payment is processed by Stripe.

Process. Verification is carried out by Yacht Cabin from the documents you submit. We may decline or revoke verification for invalid, expired, or fraudulent documents; where verification is unsuccessful, no fee is charged.

Your documents. Documents and personal data you submit for verification are processed in accordance with our Privacy Policy and retained only as long as necessary for verification and legal compliance.

EU/EEA Consumers — Right of Withdrawal

If you are a consumer in the EU/EEA, you have a 14-day right to withdraw from the identity verification service after purchase. To exercise it, contact hello@ycabin.com; we will refund the fee and your verified status may be removed.

Booking deposits relate to leisure activities supplied on a specific date and are exempt from the statutory 14-day right of withdrawal under the EU Consumer Rights Directive (2011/83/EU). Cancellations of bookings are instead governed by our Refund Policy.

Intellectual Property Infringements

Reporting Intellectual Property Infringements

If you believe that your intellectual property rights have been infringed upon, please contact us at hello@ycabin.com with the following information:

• A description of the intellectual property that you claim has been infringed.

• A description of where the material that you claim is infringing is located on the site.

• An address, telephone number, and email address where we can contact you.

• A statement by you that you have a good faith belief that the disputed use is not authorized by the intellectual property owner, its agent, or the law.

• A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the intellectual property owner or authorized to act on the owner’s behalf.

Response to Claims

Yacht Cabin will investigate and address any reported infringement notices and take appropriate actions as required by law.

Purchases and Subscriptions

Other than the optional one-time identity verification fee described above, Yacht Cabin does not sell goods (products, items) through the App and does not offer subscription plans. Booking deposits paid through the App are payments toward crew contributions, processed via Stripe as described above, and are not purchases of goods from Yacht Cabin.

Intellectual Property

Ownership and Use

All content, including logos, visual designs, and trademarks provided by Yacht Cabin, is the exclusive property of YCApps UG (haftungsbeschränkt). Unauthorized use of our content is strictly prohibited.

Use of Feedback

• Any feedback or suggestions provided by users may be implemented by Yacht Cabin without compensation or credits given.

• By submitting feedback or suggestions, you grant Yacht Cabin the right to use, disclose, and otherwise exploit the feedback or suggestions in whole or in part without any restriction or obligation to you.

Disclaimer of Warranties

Yacht Cabin is provided on an “as is” and “as available” basis. We do not warrant that the service will be uninterrupted or error-free, and we disclaim any warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

Limitation of Liability

Marketplace nature & scope

Yacht Cabin is a neutral marketplace that enables boat owners and volunteer crew to find each other. We are not a party to agreements between users and do not control, supervise, or guarantee any trip, vessel, skipper, crew, equipment, route, conditions at sea, or third-party services (including insurance, transport, visas, or port services).

Assumption of risk

Sailing and travel may involve inherent risks, including serious injury or death, illness, property damage, adverse weather, and other maritime hazards. By choosing to participate, you voluntarily assume these risks and remain solely responsible for your decisions before, during, and after any activity.

No liability for certain losses

To the maximum extent permitted by applicable law, we will not be liable to you or any third party for any:

• Indirect, incidental, special, exemplary, or consequential losses or damages;

• Loss of profits, revenue, business, contracts, data, goodwill, or anticipated savings;

• Service interruption, device or system damage/failure, or costs of substitute services;

• Loss or damage arising from experiences, activities, events or services arranged, offered, or performed by users or third parties;

• Issues arising from your failure to comply with visa, vaccination, insurance, medical, maritime or local legal requirements, or to secure your own documentation and insurance;

• Personal injury, emotional distress, reputational harm, or property damage relating to your use of our Services or to communications/interactions with other users or persons you meet through our Services;

• Loss or damage resulting from your failure to take reasonable cybersecurity precautions;

• Loss or damage caused by unauthorised use of your account where you failed to safeguard credentials or promptly notify us of suspected compromise.

System & content

We do not guarantee uninterrupted availability, error-free operation, or the accuracy, completeness, or reliability of user-generated content, listings, profiles, ratings, or reviews.

Force majeure

We will not be responsible for any failure or delay due to events beyond our reasonable control, including severe weather, natural disasters, war, terrorism, civil unrest, strikes, failures of utilities or telecommunications, satellite or GPS outages, regulatory actions, or acts/omissions of authorities.

Governing Law

Before filing any formal claim, you agree to first contact Yacht Cabin and attempt to resolve the dispute informally.

These Terms are governed by the laws of Germany. If you reside in a country whose courts require the application of local consumer protection laws for certain disputes, then your country’s laws will apply to those disputes related to these Terms. Otherwise, the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Hamburg, Germany.

Changes to the Terms

Modifications

• We reserve the right to modify these Terms at any time. Any changes we make will be posted on this page. Your continued use of Yacht Cabin after any such changes constitutes your acceptance of the new Terms.

• It is your responsibility to check this page periodically for updates.
